US State Privacy Notice

This US State Privacy Notice (“US Notice”) applies to all stores, websites (“Sites”), and mobile applications (“Apps”) owned or operated by All Saints Retail Limited (“AllSaints”) whereby AllSaints collects your information. The Sites and Apps shall be collectively referred to as the “Services.”

California Residents

If you are a California resident, this section applies to you.

Definitions

Personal information. Information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, to you or your household.

Sensitive personal information. Social security number, driver’s license number, state identification card, passport number, account log-in and password, financial account and password, debit or credit card number and access code, precise geolocation information, race, ethnic origin, religious or philosophical beliefs, union membership, the content of your mail, e-mail or texts other than those communications with us, genetic data, biometric information, health information, and information that concerns your sex life or sexual orientation.

Sell, sale, or sold. Selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or other means, your personal information to a third party for money or other valuable consideration.

Share, shared, or sharing. Sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or other means, your personal information to a third party for cross-context behavioral advertising, whether for monetary or other valuable consideration.

Right to Know/Access: You have a right to know what personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of third parties to whom we disclose personal information, and the specific pieces of personal information we have collected about you, among other information.

Right to Delete: Subject to certain conditions and exceptions, you may have the right to request deletion of your personal information.

Right to Opt-Out of Sale and Sharing: You have the right to opt-out of the sale or sharing of your personal information. Certain of the third-party cookies and related tracking technologies on our Sites may constitute a “sale” or “sharing, and you have the right to manage your cookie choices by clicking here. Our Sites also respond to global privacy control—or “GPC”—signals, which means that if we detect that your browser is communicating a GPC signal, we will process that as a request to opt that particular browser and device out of sales and sharing (i.e., via cookies and tracking tools) on our Sites. Note that if you come back to our Sites from a different device or use a different browser on the same device, you will need to opt out (or set GPC for) that browser and device as well. Right to Correct: The right to correct inaccurate Personal Information that we maintain about you.

Right to Non-Discrimination: We will not discriminate against you for exercising any of the rights described in this section.

You may submit any of the above rights by any of the following means:

Upon receipt of your request, we will take steps to verify your identity by matching the information you provide with the information we have in our records. You must complete all required fields in our webform should you choose to submit your request via webform. In some cases, we may request additional information in order to verify your request or, where necessary, to process your request. If we are unable to adequately verify a request, we will notify you. You may designate someone as an authorized agent to submit requests and act on your behalf. To do so, you must provide us with written permission to allow the authorized agent to act on your behalf.

Below is a list of the categories of personal information we have collected about California residents in the 12 months preceding the date this US Notice was last updated. This list includes information about: (1) the categories of sources from which the information was collected; (2) the business or commercial purpose for collecting, selling, or sharing the information; and (4) the categories of third parties with whom we disclose the information.

Identifiers (Includes Sensitive Personal Information): Includes information such as your name, signature, alias, postal address, and telephone number, unique personal identifier, online identifier, IP address, account log-in, e-mail address, account name, driver’s license number or other identifying information. Sensitive personal information within this category includes your driver’s license number or other identification number.

Personal Characteristics (Includes Sensitive Personal Information): Includes information such as your age and gender.

Financial Information (Includes Sensitive Information): Includes information such as your account name and log-in information, and credit card and debit card number and access code. Sensitive personal information in this category includes your account log-in and password and credit card and debit card number and access code.

Internet or other Electronic Network Activity Information: Includes information described above as automatically collected.

Commercial Information, such as records of your products considered and purchased.

Geolocation Information, such as your zip code and general location.

Audio, Electronic, Visual, Thermal, and Related Information: Includes information such as photographs, video recordings, surveillance footage, recorded messages, and other related information.

Inferences, derived from the above information.

We also draw inferences about you from the information we collect from third parties such as financial institutions, payment processors, and social networks.
Does this include sensitive personal information? Yes. * Denotes which categories may include sensitive personal information. The sensitive information we may collect includes your driver’s license number or other identification number, account information, and certain financial information.
Is the information “sold” or “shared”? Yes. We make available your IP address and other persistent online identifiers to our advertising partners. In some instances, this transaction may constitute a “sale” or “sharing” of your personal information under California law.

How long do we keep this information? We keep the information identified above for so long as is reasonably necessary and proportionate to the original purpose for which we collected the information. We base our criteria in determining appropriate retention periods on regulatory and legal requirements, contractual requirements, business needs, and the expectations of you.

We “sell” and “share” your personal information through the use of digital advertising through our Services. Specifically, we make available certain of your online identifiers and other persistent online identifiers with advertising and marketing partners that may be considered a “sale” or “sharing” of your personal information, as defined under California law. We don’t sell or share the personal information or sensitive personal information of any California resident who is 16 years or younger. We do not use your sensitive personal information for purposes other than permitted under the CCPA. Specifically, we do not use your sensitive personal information to derive characteristics about you.

Material Terms of Incentive
AllSaints provides a discount of 15% off full price styles on a customer’s first order in exchange for providing certain Personal Information, such as a user’s e-mail address. The 15% discount only applies to the first purchase made by new subscribers to the AllSaints Newsletter.

How The Incentive Is Reasonably Related To The Personal Information Provided
Our discount program is based upon our reasonable but sole determination of the estimated value of the Personal Information of California residents provided, which takes into consideration, without limitation, estimates regarding the anticipated revenue generated from such information, the anticipated expenses which might be incurred in the collection, storage, and use of such information in the operation of our business, and other relevant factors related to the estimated value of such information to our business, as permitted under applicable law. Based on this analysis, we value the e-mail address we receive as equivalent to 15% off the average purchase by consumers.

Opt-In
By providing your personal information in exchange for a discount, you are affirmatively opting-in to our financial incentive program as described above. If you wish to opt-out of the program, do not submit the personal information.

Right to Withdraw
If you wish to withdraw from receiving a discount in exchange for the personal information you provided, please send an e-mail to ask@allsaints.com before any such discount it utilized. You may also opt-out of such participation at any time by clicking unsubscribe at the bottom of our emails or by logging into your online account and clicking “Contact preferences” under “Profile Details.”

If you are a California resident and our customer, you have the right to request information from us once per calendar year regarding the customer information we share with third parties for the third parties’ direct marketing purposes. To request this information, please send an email to ask@allsaints.com “Shine the Light Request” in the subject line and in the body of your message. We will provide the requested information to you via an email response.

If you are a California resident under the age of 18, California Business and Professions Code § 22581 permits you to request and obtain removal of content or information you have publicly posted on any of our Sites. To make such a request, please send an email with a detailed description of the specific content or information to ask@allsaints.com with the subject line “CALIFORNIA MINOR CONTENT REMOVAL REQUEST.” Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and there may be circumstances in which the law does not require or allow removal even if requested.

Under California law, website operators are required to disclose how they respond to web browser “do not track” signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Information of a consumer over time and across third party websites, to the extent the operator engages in that collection. At this time, we do not track our customers’ Personal Information over time and across third-party websites. Further, AllSaints does not knowingly permit third parties to collect Personal Information about an individual consumer’s online activities over time and across different web sites when a consumer uses our Services.

If you are a Nevada resident, you have the right to submit a request directing us not to make any sale of your personal information. AllSaints does not sell your personal information for money. However, to request email confirmation that we will not sell your personal information in the future, please send an email to ask@allsaints.com with “Nevada Opt-Out” in the subject line and in the body of your message.

This section applies to residents of Virginia, Colorado, Connecticut, and Utah as defined under the Virginia Consumer Data Protection Act, the Colorado Privacy Act, the Connecticut Data Privacy Act, and the Utah Consumer Privacy Act.


Definitions

Personal data. Information that is linked or reasonably linkable to an identified or identifiable individual.

Sensitive personal data. Information that includes data revealing racial or ethnic origin, the processing of genetic or biometric data for the purpose of uniquely identifying an individual or precise geolocation data.

Sell, sale, or sold. The exchange of personal data for monetary or other valuable consideration.

Targeted advertising. Displaying advertisements to a consumer where the advertisement is selected based on personal data obtained or inferred from that individual’s activities over time and across nonaffiliated Internet web sites or online applications to predict such individual’

Right to Know and Access: You have a right to know whether AllSaints is processing your personal data, access such personal data subject to certain exceptions, and obtain a copy of the personal data in a portable format.

Right to Delete. Subject to certain conditions and exceptions, you have a right to request that we delete your personal data.

Right to Correct. Subject to certain conditions and exceptions, you have a right to ask that AllSaints correct the personal data it has about you, subject to certain exceptions.

Right to Opt-Out of the Sale or Targeted Advertising. You have a right to opt-out of the sale or use of your personal data for targeted advertising. The process for exercising this right is described at Do Not Sell or Share My Personal Information.

Right to Non-Discrimination. You have a right not to be discriminated against for the exercise of your rights described herein.

We will respond to your appeal within the timeframe required by law, and provide a written explanation in support of our response and provide additional information as required by law.
