California Privacy Notice

Effective date: October 12, 2022

This California Privacy Notice (“California Notice”) applies to all stores, websites (“Sites”), and mobile applications (“Apps”) owned or operated by All Saints Retail Limited (“AllSaints”) whereby AllSaints collects the Personal Information (as defined below) of California residents. The Sites and App shall be collectively referred to as the “Services.” In this California Notice, “we”, “our”, and “us” refers to AllSaints, and “you”, “your”, “user” mean uses of the Services.

Please read this California Notice carefully. BY ACCESSING AND/OR USING OUR SITES, VISITING OUR STORES, USING OUR SERVICES, OR COMMUNICATING WITH US IN ANY MANNER, YOU REPRESENT THAT YOU HAVE READ AND UNDERSTOOD THIS CALIFORNIA NOTICE.

All terms and phrases used herein shall have the same meaning as set forth under the California Consumer Privacy Act of 2018, as amended, and its related regulations (“CCPA”).

Under the CCPA, California residents have the right to receive certain disclosures regarding our processing and sharing of “Personal Information,” as defined under the CCPA.

Right to Access: With respect to the Personal Information we have collected about you in the prior 12 months, you have the right to request from us (up to twice per year and subject to certain exemptions):

  • Categories of Personal Information about you we have collected;
  • The sources from which we have collected that Personal Information;
  • Our business or commercial purposes for collecting, selling, or sharing that Personal Information;
  • The categories of third parties to whom we have disclosed that Personal Information; and
  • A copy of the specific pieces of your Personal Information we have collected.
  • Right to Delete: Subject to certain conditions and exceptions, you may have the right to request deletion of Personal Information that we have collected about you.

    California consumers who are registered users of the Sites and/or App and under 18 years of age may request the removal of content or information they posted on the site. We will remove such content or information when we are required to do so by law. To request the removal of content or information you posted on the Sites and/or App you may contact us as described below. Please note that even if we remove the content or information that you posted, we cannot prevent further use or disclosure of that content or information by others once you have shared it publicly.

    Right to Opt-Out of Sale: Although we do not sell your Personal Information in the traditional sense, the definition of “sale” under the CCPA is very broad and may cover many common business activities not otherwise considered a “sale”, such as sharing certain technical information with third party data analytics, marketing, and advertising partners.     Right to Non-Discrimination: We will not discriminate against you for exercising any of the rights described in this section.

    Authorized Agent: You may designate someone as an authorized agent to submit requests and act on your behalf. To do so, you must provide us with written permission to allow the authorized agent to act on your behalf.

    Right to Know:The chart below describes the categories of Personal Information we collect, the categories of sources from which the Personal Information is collected, our purposes for processing each category, whether we have disclosed Personal Information for a business purpose in the last 12 months, and the categories of recipients.

    To the extent permitted by applicable law, we will retain your Personal Information only for as long as AllSaints believes it is necessary to fulfill the purposes for which it was collected, including for the purpose of meeting any legal, accounting, or other reporting requirements or obligations.

    Audio, visual and other electronic data: Such as photographs.  AllSaints does not share this category of Personal Information.
    Profiles and inferences: Including inferences drawn from any of the information identified above to create a profile reflecting a consumer’s preferences, characteristics, behavior or attitudes. Advertisers and advertising networks; analytics providers
    Protected classifications: We collect some information that is considered a protected classification under California/federal law e.g., your gender, if you choose to share your preference). Advertisers and advertising networks; analytics providers

    We process the Personal Information we collect about you for the following purposes:

  • Providing our Services
  • Marketing
  • Tailored advertising and ad effectiveness
  • To influence our product decisions
  • Personalization
  • Responding to inquiries
  • Improving our Services
  • In support of our general business operations
  • Protecting our rights and responding to legal requests/obligations
  • In the preceding twelve months, we have collected Personal Information from the following categories of sources:

  • Directly from individuals
  • Third party cookies, analytics, and marketing partners
  • Vendors and service providers
  • If any of the rights described above apply to you, you may exercise your rights by any of the following means:

  • Submitting a CCPA Request Form
  • We will take steps to verify your request by matching the information provided by you with the information we have in our records. In some cases, we may request additional information in order to verify your request or, where necessary, to process your request. If we are unable to adequately verify a request, we will notify the requestor.

    Under the CCPA, a “sale” includes disclosing or making available Personal Information to a third-party in exchange for monetary compensation or other benefits or value. There may be a limited set of your Personal Information that is provided to Rakuten Advertising whereby Rakuten Advertising may receive some value from your information. Under the CCPA, this may constitute a “sale” of your information. The type of information shared with Rakuten Advertising may include your IP address, digital identifiers, information about your web browsing and usage of our Services, information about how you interact with our ads, and certain analytic information. Please visit Rakuten Advertising’s Privacy Policy for more information. We have no actual knowledge that we sell the Personal Information of California residents who are under 16 years of age.

    Material Terms of Discount Program


    AllSaints provides a discount of 15% off full price styles on a customer’s first order in exchange for providing certain Personal Information, such as a user’s email address. The 15% discount only applies to the first purchase made by new subscribers to the AllSaints Newsletter.

    Our discount program is based upon our reasonable but sole determination of the estimated value of the Personal Information of California residents provided, which takes into consideration, without limitation, estimates regarding the anticipated revenue generated from such information, the anticipated expenses which might be incurred in the collection, storage, and use of such information in the operation of our business, and other relevant factors related to the estimated value of such information to our business, as permitted under applicable law. Based on this analysis, we value the e-mail address we receive as equivalent to 15% off the average purchase by consumers.

    California Civil Code § 1798.83 permits you to request information regarding the disclosure of your information by us to third parties for their direct marketing purposes. Note that our response to these requests will be duplicative of and more limited than its response to Right to Know requests under the CCPA (described above).     If you are a California resident under the age of 18, California Business and Professions Code § 22581 permits you to request and obtain removal of content or information you have publicly posted on any of our Sites. To make such a request, please send an email with a detailed description of the specific content or information to ask@allsaints.com with the subject line “CALIFORNIA MINOR CONTENT REMOVAL REQUEST.” Please be aware that such a request does not ensure complete or comprehensive removal of the content or information you have posted and there may be circumstances in which the law does not require or allow removal even if requested.

    Under California law, website operators are required to disclose how they respond to web browser "do not track" signals or other similar mechanisms that provide consumers the ability to exercise choice regarding the collection of Personal Information of a consumer over time and across third party websites, to the extent the operator engages in that collection. At this time, we do not track our customers' Personal Information over time and across third-party websites. Further, AllSaints does not knowingly permit third parties to collect Personal Information about an individual consumer's online activities over time and across different web sites when a consumer uses our Services.

    This California Notice is current as of the Effective Date set forth above. We may change this California Notice from time to time, so please be sure to check back periodically. We will post any changes to this California Notice on our Sites and/or Apps.
